The US Justice Department has changed its stance on defending former US President Donald Trump in a defamation lawsuit brought by author E Jean Carroll, saying his presidency does not exempt him from the lawsuit. That paves the way for a potential trial in the case in January.
The US Department of Justice said in a court filing on 11 July that Trump was not acting in his presidential capacity when he made the alleged defamatory comments about Carroll in 2019.
E. Jean Carroll is a former columnist for Elle magazine. She claimed she was sexually assaulted by Trump in a New York department store in 1996, but Trump dismissed the claim as "a total hoax."
On June 27, Trump sued Carroll for defamation, claiming she falsely accused him of sexual assault. Carroll had previously accused Trump of sexual assault and later accused him of defamation.
Carroll, 79, has previously won a court case against Trump. In May, a New York court jury found Trump liable for sexually abusing and defaming Carroll, but ruled that he did not sexually assault her and ordered him to pay her $5 million in damages.
Trump claimed immunity because he made the remarks while speaking to the press as president.
At first, the US Department of Justice agreed. But in a July 11 court filing, lawyers cited new evidence. According to the New York Times, the new evidence suggests that "Mr. Trump was motivated by 'personal grievances' stemming from events that occurred years before he became president." The Justice Department's reversal could put Trump at a disadvantage.
Roberta Kaplan, Carroll's attorney, welcomed the decision. "We are grateful that the Department of Justice has reconsidered its position," she said in a statement. "We have always maintained that Donald Trump's defamatory comments about Carroll in June 2019 were made out of personal malice and spite, not because he is President of the United States."
